As Next Generation Sequencing technologies are increasingly implemented in biomedical research and care, the number of study participants and patients who ask for release of their genomic raw data is set to increase. This raises the question whether research participants and patients have a legal and moral right to receive their genomic raw data and, if so, how this right should be implemented into practice. In a first step we clarify some central concepts such as “raw data”; in a second (...) step we sketch the international legal framework. The third step provides an extensive ethical analysis which comprehends two parts: an evaluation of whether there is a prima facie moral right to receive one’s raw data, and a contextualization and discussion of the right in light of potentially conflicting interests and rights of the data subject herself and third parties; in a last fourth step we emphasize the main practical consequences of the ethical analyses and propose recommendations for the release of raw data. In several legislations like the new European General Data Protection Regulation, patients do in principle have the right to receive their raw data. However, the procedural implementation of this right and whether it involves genetic counselling is at the discretion of the Member States. Even more questions remain with respect to the research context. The ethical analysis suggests that patients and research subjects have a moral right to receive their genomic raw data and addresses aspects which are also of relevance for the legal discussion such as the costs of release of raw data and its impact on academic freedom. Taking into account the specific nature and implications of genomic raw data and the contexts of research and health care, several concerns and potentially conflicting interests of the data subjects themselves and involved researchers, physicians, biomedical institutions and relatives arise. Instead of using them to argue in favor of restrictions of the data subjects’ legal and moral right to genomic raw data, the concerns should be addressed through provision of information and other measures. The purpose of this chapter is to offer an ethical investigation into whether researchers have a duty to share pre-published bio-medical data with the scientific community. The central questions of the chapter are the following: do researchers have a prima facie duty to share pre-published data? And if so, what stakes and aspects of a concrete situation need to be taken into consideration in order to assess whether and to what extent researchers’ prima facie duty to share data applies? We (...) will argue that based upon their basic duties to benefit society and to promote scientific knowledge, researchers have a prima facie duty to share data. We will also argue that in order to determine whether the prima facie duty applies in practice it is indispensable to take into account the stakes of the persons concerned as well as context dependent aspects. The chapter’s overall goal is to build an analytical and ethical framework that helps to assess with regard to concrete situations whether researchers’ duty to share data applies. To this end we analyse the concept of data sharing and clarify what data sharing might imply in practice. To offer an overview of the different stakeholders’ concerns we will analyse the normative-informational environment in which data producing researchers (to whom the prima facie duty to share data applies) are usually situated. In the last step we focus on the ethically relevant context dependent aspects and illustrate how they affect researchers’ prima facie duty to share data and stakeholders’ potentially conflicting stakes. Die Anwendung des Begriffs auf Kinder birgt darüber hinaus eine Reihe von spezifischen Schwierigkeiten. Knüpft man den MS an bestimmte höhere geistige Fähigkeiten wie Vernunft oder Sprachfähigkeit – wie es in einigen weit verbreiteten Ethiken der Fall ist –, so stellt sich mit Blick auf sehr junge Kinder sogleich die Frage, ob diese (...) entsprechend keinen oder nur einen niedrigeren MS zugesprochen bekommen. In Demokratien gibt es gewöhnlich ein gesetzliches Mindestalter, durch das Kinder und Jugendliche von politischen Wahlen ausgeschlossen werden. Je nach Altersstruktur der Bevölkerung dürfen ungefähr 20 bis 25 Prozent der Staatsbürger eines Landes nicht wählen. In diesem Aufsatz werden der Ausschluss Minderjähriger von Wahlen in Demokratien sowie mögliche alternative Stellungen Minderjähriger im Wahlrecht einer ethischen Analyse unterzogen. Die erste zentrale These des Aufsatzes lautet, dass der Ausschluss und die Nichtrepräsentation von Minderjährigen ungerecht ist, dass die Regierungsgewalt über Minderjährige in demokratischen (...) Staaten nicht ausreichend legitimiert ist und dass Kinder und Jugendliche gute Gründe dafür haben, sich gegen Gesetze und Maßnahmen ihrer Regierung mit Akten des zivilen Ungehorsams zu wehren. Die zweite zentrale These des Aufsatzes lautet, dass der beste Weg zur Aufhebung dieses Zustands der Ungerechtigkeit und mangelnden Legitimation in der Einführung einer Pflicht der Eltern besteht, stellvertretend für ihre Kinder zu wählen. Diese elterliche Pflicht sollte durch ein Vetorecht der Minderjährigen ab 14 Jahren ergänzt werden. (shrink)

ZusammenfassungSystemmedizinische Ansätze zeichnen sich durch die Integration großer Datenmengen aus vielfältigen Datenquellen aus und führen systembiologische und medizinische Forschungsansätze mit informationswissenschaftlichen Methoden und prädiktiven Verfahren mathematischer Modellierung zusammen. Hieraus resultiert eine enge Kooperation von Ärzten und Naturwissenschaftlern, wobei insbesondere die Expertise nicht-ärztlicher Forscher zunehmend an Bedeutung für die Datenaufbereitung und -interpretation gewinnt. Aus ethischer Perspektive wirft diese Entwicklung Fragen nach der konkreten Gestaltung einer systemmedizinischen Zusammenarbeit sowie möglichen Rollenveränderungen und neuen Verantwortungszuschreibungen an Ärzte und nicht-ärztliche Forscher auf. Um diese Fragen (...) mit Blick auf die Erfahrungen und Perspektiven der beteiligten Akteursgruppen zu beleuchten, führten wir eine qualitative Interviewstudie mit Ärzten und nicht-ärztlichen Forschern aus unterschiedlichen systemmedizinischen Kontexten durch. Aus dem Interviewmaterial ließen sich zwei Konzeptionen von Systemmedizin rekonstruieren. Die erste ist durch eine eindeutige arbeitsteilige Rollentrennung zwischen Ärzten und Forschern charakterisiert: Der Forscher fungiert als Dienstleister, der Arzt als translationaler, interdisziplinär ausgerichteter Mediziner. Die zweite zeichnet sich durch eine weitreichende Aufhebung der Rollentrennung von Ärzten und Forschern aus: Die Berufsgruppen agieren als interdisziplinäres Team mit einer engen wechselseitigen inhaltlichen und methodischen Zusammenarbeit der Akteure. In beiden Konzeptionen werden Rollenkonflikte von Ärzten und Forschern deutlich, die insbesondere auf die Diskrepanz zwischen dem Arzt- und Forscherethos und die mit ihnen je verknüpften spezifischen Handlungsnormen und Ziele zurückzuführen sind. Ferner besteht mit Blick auf die dem Arzt und Forscher jeweils zukommende Verantwortung gegenüber Patienten vielfältiger normativer Klärungsbedarf, insbesondere hinsichtlich der Frage, welche Verantwortung den Akteursgruppen gerechtfertigter Weise zugeschrieben werden kann. Diesbezüglich erscheint eine Differenzierung von versorgungsnäheren und grundlagenforschungsorientierten Arbeitsfeldern angeraten. (shrink)

Molecular tumour boards (MTBs) offer recommendations for potentially effective, but potentially burdensome, molecularly targeted treatments to a patient's treating physician. In this paper, we discuss the question of who is responsible for ensuring that there is an adequate evidence base for any treatments recommended to a patient. We argue that, given that treating oncologists cannot usually offer a robust evaluation of the evidence underlying an MTB's recommendation, members of the MTB are responsible for ensuring that the evidence level is adequate. (...) We explore two models for how to share responsibility between MTB members. According to the first model, each MTB member, as well as the treating physician, should be held maximally and equally responsible for the recommendations. We argue that this insufficiently accounts for differences in roles and expertise of MTB members. We propose instead that responsibility is delegated via relationships of trust. We argue if these relationships of trust are to be instances of reasonable trust, (a) MTBs should offer a clinical representative to whom a treating physician may delegate the responsibility of ensuring there is sufficient evidence for treatment recommendations, (b) the relationships of trust between the representative and the other MTB members should be clearly defined, and (c) MTB members should be carefully selected. Treating oncologists retain a responsibility to consider general limitations of the evidence for targeted treatments in assessing whether the treatment recommendation offered by an MTB's representative is adequate for a given clinical situation. Sharing research data has great potential to benefit science and society. However, data sharing is still not common practice. Since public research funding agencies have a particular impact on research and researchers, the question arises: Are public funding agencies morally obligated to promote data sharing? We argue from a research ethics perspective that public funding agencies have several pro tanto obligations requiring them to promote data sharing. However, there are also pro tanto obligations that speak against promoting data sharing in (...) general as well as with regard to particular instruments of such promotion. We examine and weigh these obligations and conclude that all things considered funders ought to promote the sharing of data. Even the instrument of mandatory data sharing policies can be justified under certain conditions. (shrink)

Secondary use of clinical data in research or learning activities (SeConts) has the potential to improve patient care and biomedical knowledge. Given this potential, the ethical question arises whether physicians have a professional duty to support SeConts. To investigate this question, we analyze prominent international declarations on physicians’ professional ethics to determine whether they include duties that can be considered as good reasons for a physicians’ professional duty to support SeConts. Data-sharing among genomic researchers is promoted for its potential to accelerate our understanding of the molecular basis of cancer. However, with genomic data sharing the risks of re-identifying study participants, revealing personal genomic information and data misuse might increase. This study aims at exploring perceptions of patients and physicians in Oncology regarding their assessment of the informational risks resulting from participating in whole genomic research studies in order to improve the informed consent process. For this purpose, we conducted a qualitative (...) focus group study at the National Center for Tumor Diseases (NCT). Patients and oncologists assessed the informational risks either as minimal or as greater than minimal, depending on the context factors of occupational status, age, and patients’ prognosis. Interestingly, even patients who assumed a greater risk did not refrain from participating in genomic research, provided that certain informational and institutional safeguards are implemented. Moreover, they expected comprehensive disclosure of the risks resulting from genomic data sharing. These results suggest (1) comprehensive disclosure of the risks of genomic research to potential study participants in genomic research to facilitate risk assessment and sound decision making, (2) establishing independent governance entities in order to minimize the informational risks of genomic research, and (3) implementing data sharing policies which offer guidance for physicians and researchers involved in genomic research. Research question The secondary use of clinical data for research and learning activities has the potential to significantly improve medical knowledge and clinical care. To realize this potential, an ethical and legal basis for data use is needed, preferably in the form of patient consent. This raises the question: Do patients have a moral duty to provide their clinical data for research and learning activities? Methods On the basis of an ethical approach that we call “caring liberalism,” we evaluate plausibility (...) and moral weight of the following arguments in favor of a duty on patients to provide their clinical data for research and learning activities: the general duty to help; solidarity; the duty to act in the public interest; the free-rider argument; transgenerational justice; the principle of giving back; the do-not-harm principle; freedom of research and the value of science. Results The general duty to help and the duty to act in the public interest are strong reasons for a moral duty of patients to provide their clinical data for research and learning activities. Transgenerational justice and the principle of giving back are ethically weak reasons for such a duty but might be motivational factors. The other reasons are not appropriate to justify a duty. The results are relevant in several respects: for patients who are asked to consent to the secondary use of their clinical data; for the ethical discussion of the question whether and to what extent deviations from the classical specific consent are ethically justifiable under certain conditions; for the legal discussion of the conditions for a proportionate secondary use of clinical data for research and learning activities. Die sekundäre Forschungsnutzung von Behandlungsdaten hat großes Potenzial, biomedizinisches Wissen zu erweitern und die Patientenversorgung zu verbessern. Gleichzeitig sind für eine bessere Ausschöpfung dieses Potenzials diverse Herausforderungen zu bewältigen. Dies gilt insbesondere in Deutschland, wo im Vergleich zu anderen Ländern, wie z.B. Dänemark oder Finnland, die sekundäre Forschungsnutzung von Behandlungsdaten unterentwickelt ist. Die Intensivierung der Nutzung der Daten aus Diagnose und Therapie von Patienten und die Entwicklung der dafür notwendigen Strukturen in Deutschland ist ethisch und politisch geboten: für die Verbesserung (...) der Gesundheitsversorgung durch neue Erkenntnisse, Therapien und Qualitätssicherung. Aus diesem Grund fordern die Autor:innen alle Akteure des Gesundheitssystems, von der Bundes- und den Landesregierungen über die Krankenkassen, Kliniken, Ärzt:innen und Patient:innen dazu auf, einen Beitrag dazu leisten, eine Kultur der sekundären Forschungsnutzung von Behandlungsdaten zu etablieren. Basierend auf den Ergebnissen eines dreijährigen Verbundprojekts beantworten die Autor:innen aus den Bereichen Medizin, Rechtswissenschaften, Ethik und Sozialwissenschaften die Frage was notwendig ist, damit in Deutschland die Daten von Patient:innen systematisch für medizinische Forschung und die Analyse der klinischen Versorgungsqualität verwendet werden können und wirklich auch verwendet werden. Research question The secondary research use of treatment data has the potential to expand medical knowledge and improve patient care. Hospitals play an important role in systematic secondary research use: they generate large amounts of treatment data and are supposed to establish the necessary structures for their use in research. This raises the ethical question: do hospitals have a moral duty to support secondary research use of treatment data by establishing and operating the necessary resources and infrastructure? Procedure Our aim (...) is to outline a conceptual framework to discuss the question and to propose a first normative position. Building on insights from business and organizational ethics, we develop a conceptual framework in which we view hospitals as moral actors. Our normative-ethical analysis is based on a reconstructive stakeholder approach, in which we identify the following general duties of hospitals: orientation towards patient wellbeing; cost efficiency; enabling employees to act in accordance with professional ethical standards; supporting public health and research. We examine whether these general duties provide reasons for a specific duty of hospitals to support secondary research use of treatment data. We discuss potential objections to such a duty arising from other, potentially conflicting general duties of hospitals (e.g., data protection), from practice (e.g., costs/resources), or related discourses (data ownership). Conclusion Certain general duties (orientation towards patient wellbeing, cost efficiency, support of public health) justify a duty of hospitals to support secondary research use of treatment data. The duty to enable employees to act in accordance with professional ethical standards is only an indirect reason; the duty to support research applies solely to university hospitals. BackgroundResearch using data from medical care promises to advance medical science and improve healthcare. Academia is not the only sector that expects such research to be of great benefit. The research-based health industry is also interested in so-called ‘real-world’ health data to develop new drugs, medical technologies or data-based health applications. While access to medical data is handled very differently in different countries, and some empirical data suggest people are uncomfortable with the idea of companies accessing health information, this paper (...) aims to advance the ethical debate about secondary use of medical data generated in the public healthcare sector by for-profit companies for medical research (ReuseForPro).MethodsWe first clarify some basic concepts and our ethical-normative approach, then discuss and ethically evaluate potential claims and interests of relevant stakeholders: patients as data subjects in the public healthcare system, for-profit companies, the public, and physicians and their healthcare institutions. Finally, we address the tensions between legitimate claims of different stakeholders in order to suggest conditions that might ensure ethically sound ReuseForPro.ResultsWe conclude that there are good reasons to grant for-profit companies access to medical data if they meet certain conditions: among others they need to respect patients’ informational rights and their actions need to be compatible with the public’s interest in health benefit from ReuseForPro. Zusammenfassung Die sekundäre Forschungsnutzung von Behandlungsdaten hat Potenzial, medizinisches Wissen zu erweitern und die Patientenbehandlung zu verbessern. Für eine systematische sekundäre Forschungsnutzung spielen Krankenhäuser eine wichtige Rolle: sie erzeugen große Mengen an Behandlungsdaten und müssen für deren Forschungsnutzung die notwendigen Strukturen aufbauen. Damit stellt sich die ethische Frage: Haben Krankenhäuser eine moralische Pflicht, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen, indem sie dafür notwendige Ressourcen und Infrastrukturen aufbauen und betreiben? Ziel ist es, eine konzeptionelle Herangehensweise zur Erörterung dieser Frage zu skizzieren (...) und eine erste normative Positionierung vorzuschlagen. Auf Beiträge aus der Wirtschafts- und Organisationsethik zurückgreifend, erarbeiten wir einen begrifflichen Rahmen, der Krankenhäuser als moralische Akteure versteht. Die normativ-ethische Analyse basiert auf einem rekonstruktiven Stakeholder-Ansatz, in dessen Rahmen wir folgende Pflichten von Krankenhäusern ausmachen: Orientierung am Patientenwohl, Kosteneffizienz, Ermöglichung von professionellem Handeln, Unterstützung von öffentlicher Gesundheit, Förderung von Forschung. Es wird untersucht, ob diese allgemeinen Pflichten Gründe für eine spezielle Pflicht von Krankenhäusern darstellen, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen. Mögliche Einwände gegen eine solche Pflicht, welche sich u. a. aus anderen, potenziell konfligierenden allgemeinen Pflichten der Krankenhäuser (z. B. Datenschutz), aus der Praxis (z. B. Aufwände) oder eventuellen Ansprüchen (Dateneigentum) ergeben, werden diskutiert. Bestimmte allgemeine Pflichten (Orientierung am Patientenwohl, Kosteneffizienz, Unterstützung öffentlicher Gesundheit) begründen eine Pflicht von Krankenhäusern, sekundäre Forschungsnutzung von Behandlungsdaten zu unterstützen. Die Pflicht zur Ermöglichung professionellen Handelns ist nur ein indirekter Grund; die Pflicht zur Forschungsunterstützung trifft nur auf Universitätskliniken zu. Mögliche Einwände haben teilweise Gewicht, können aber durch gezielte Maßnahmen eingedämmt werden. (shrink)

Este artigo tem por objetivo analisar a aparente contradição entre a instituição da censura no Contrato Social de Rousseau e a censura que sofreu em Genebra e Paris. Para tanto analisaremos o conceito de censura no Contrato Social e os argumentos utilizados por Rousseau nas obras Cartas escritas da Montanha e a Carta à Christophe Beaumont, com apoio na obra de alguns comentadores da obra política de Rousseau. Nossos estudos nos levam a concluir que Jean-Jacques Rousseau admite, de fato, a (...) possibilidade da instituição da censura, no entanto, a ação dos censores deve ser restrita pela opinião pública, tal como a do príncipe em relação às leis. Além disso, se há um processo semelhante deveria atender todos os requisitos da legislação civil do Estado no qual ocorre. Tanto em Paris, como em Genebra Rousseau discorda do modo como procederam em relação às suas obras e sua pessoa. (shrink)

When Adolf Hitler (1889–1945) came to power in 1933, the new Nazi government focused the German health system on their priorities such as the creation of a racially homogeneous society and the preparation of war. One of the measures to bring nursing under their control was the foundation of a new sisterhood. In 1934, Erich Hilgenfeldt (1897–1945), the ambitious head of the National Socialist People’s Welfare Association (Nationalsozialistische Volkswohlfahrt), founded the National Socialist (NS) Sisterhood (Nationalsozialistische Schwesternschaft) to create an elite (...) group that would work for the goals of the National Socialist German Workers’ Party (Nationalsozialistische Deutsche Arbeiterpartei, NSDAP). Hilgenfeldt proclaimed community nursing as a priority for NS Sisterhood nurses. Catholic and Protestant sisters, who were traditionally dedicated to community nursing, were to be gradually replaced. However, other competing priorities, such as hospital service for the training of junior nurses and work in conquered regions, as well as the lack of NS nursing personnel, hampered the expansion of community nursing. The paper also addresses areas for future research: everyday activities of NS nurses, the service of NS Sisterhood nurses for NSDAP organisations such as the elite racist paramilitary force SS (Schutzstaffel, Protective Squadron), and involvement in their crimes have hardly been investigated as yet. Normativity is both one of the most important and ubiquitous of phenomena and, despite its historical centrality to philosophy, one of the least understood. The idea that there might be objective, attitude-independent, truths about what we ought to do (morality), what we ought to believe (rationality) or what we ought to appreciate (aesthetics), has always seemed very puzzling to philosophers, even though ordinary thought seems steeped in such judgments. -/- Up until quite recently, the received view was that there was (...) no good way to make sense of such a realistic, objectivist construal of normativity, that we have to make do with one or another anti-realistic alternative, principally, Expressivism, some forms of Constructivism, or Relativism. However, the well-known difficulties with these anti-realist options have motivated philosophers, most especially younger ones, to take a fresh look at Realism and to assess and develop it in new ways. Sometimes the result is that Realism is seen to be better protected against classic objections than had been previously realized; at others, the result seems to be that Realism is even harder to defend, and perhaps even harder to understand, than traditional thinking had allowed. The upshot is a vigorous and stimulating debate that is just beginning to take shape and whose outcome is far from resolved. -/- The main impulse behind the present volume was to commission new work on Normative Realism by a mix of senior and junior scholars to give the philosophical community a useful sense of the current state of play on this central topic. ... Assertion is the central vehicle for the sharing of knowledge. Whether knowledge is shared successfully often depends on the quality of assertions: good assertions lead to successful knowledge sharing, while bad ones don't. In Sharing Knowledge, Christoph Kelp and Mona Simion investigate the relation between knowledge sharing and assertion, and develop an account of what it is to assert well. More specifically, they argue that the function of assertion is to share knowledge with others. It is this function that (...) supports a central norm of assertion according to which a good assertion is one that has the disposition to generate knowledge in others. The book uses this functionalist approach to motivate further norms of assertion on both the speaker and the hearer side and investigates ramifications of this view for other questions about assertion. This article consists of three parts, two introductory, in which the limits and the methods of analysis of dialogues are expounded, and the major part, in which the main features of a philosophical theory of disputation are outlined.It was an essential aim of the philosophical analysis of argumentative dialogues to develop tools of substantiation for cases in which logic doesn't help any more. In the first part of this paper I show that such tools can and will be developed only (...) by analyzing argumentations (“argumentation” in the sense of a monologue in which arguments for a thesis are brought forward), and that the analysis of argumentative dialogues doesn't contribute anything to the development of such tools.The systematically first task of the philosophical analysis of dialogues consists in understanding the general practical aims of philosophically interesting types of dialogue. Only subsequently the rules of the dialogue can be reconstructed as good means for reaching these aims. Dialogical games constructed without referring to such a purpose are externally senseless and useless.The third part is an outline of a philosophical theory of disputation (“disputation” here will mean: (learned) dialogue in which the participants cooperatively though perhaps controversially attempt to find out by means of arguments and mutual criticism whether a thesis is true or false). Disputations contain argumentations, and many functions of a disputation can also be fulfilled by argumentations alone. Certifying the truth of convictions is the specific aim of disputation. This is accomplished by eliminating errors of substantiation and foundation as effectively as possible, in revising false convictions and their foundations, thereby making the remaining convictions more certain. Based on this analysis of the aim of disputation, the basic rules of disputations will be critically reconstructed: possible moves, rules of sequence, and the internal aim and ends of disputations. Berlin has become the German place of remembrance for 1968. In other cities, too, students, artists, and professors rose up against authoritarian ways of life and institutions, pointing to the “fascism” of the Nazi period that their parents wished to repress. But remembrance likes the beauty of appearances, and the revolt in Berlin was initially colored by something unreal and playful, a counterpoint led to its conclusion, something both bounded and experimental. This something was lost between 1967 and 1969, though (...) it was even less present outside of Berlin, perhaps because of the delay with which the revolt spread beyond.. (shrink)

This paper explores the phenomenon of meta-emotions. Meta-emotions are emotions people have about their own emotions. We analyze the intentional structure of meta-emotions and show how psychological findings support our account. Acknowledgement of meta-emotions can elucidate a number of important issues in the philosophy of mind and, more specifically, the philosophy and psychology of emotions. Among them are (allegedly) ambivalent or paradoxical emotions, emotional communication, emotional self-regulation, privileged access failure for repressed emotions, and survivor guilt.

Epistemic democracy aims to show, often by appeal to the Condorcet Jury Theorem, that democracy has a high chance of reaching correct decisions. It has been argued that epistemic democracy is compatible with various metaethical accounts, such as moral realism, conventionalism and majoritarianism. This paper casts doubt on that thesis and reveals the following metaethical dilemma: if we adopt moral realism, it is doubtful that voters are, on average, more than 0.5 likely to track moral facts and identify the correct (...) alternative. By contrast, if we adopt conventionalism or majoritarianism, we cannot expect that voters are both competent and sincere. Either way, the conditions for the application of Condorcet’s theorem are not met. (shrink)

An influential thought-experiment by Derek Parfit sought to establish that people have a preference for unpleasant events to lie in the past rather than the future. In recent discussions of Parfit’s argument, this purported preference is modelled as a discounting phenomenon, as is the tensed emotion of relief, which Arthur Prior argued demonstrated that there is an objective metaphysical difference between the past and the future. Looking at recent work demonstrating some psychological past/future asymmetries that are more clearly instances of (...) discounting I argue that this existing philosophical literature fails to distinguish between what are clearly two quite different psychological phenomena. This affects recent attempts to respond to Prior’s metaphysical argument, because it is not clear that they have identified the right phenomenon to be explained. It also affects Parfit’s thought-experiment, because the purported unitary ‘preference’ may in fact be an amalgam of these two quite different psychological phenomena. (shrink)

Seng Zhao and his collection of treatises, the Zhao lun, have enjoyed a particularly high reputation in the history of Chinese Buddhism. One of these treatises, The Immutability of Things, employs the Madhyamaka argumentative method of negating dualistic concepts to demonstrate that, while "immutability" and "mutability" coexist as the states of phenomenal things, neither possesses independent self-nature. More than a thousand years after this text was written, Zhencheng's intense criticism of it provoked fierce reactions among a host of renowned scholar-monks. (...) In der Architekturtheorie ist häufig von der Identität von Bauwerken oder Städten die Rede. Der Ausdruck „Identität“ bezieht sich dabei auf etwas, was man „spezifischen Charakter“ nennen könnte. Wir schlagen eine symboltheoretische Explikation dieses Identitätsbegriffs vor und zeigen, in welchem Sinn ein Bauwerk verschiedene, sich verändernde oder gar konfligierende Identitäten haben kann. Identitäten von Bauwerken werden oft als mehr oder weniger klar, positiv, angemessen oder stark bewertet. Solche Attribute diskutieren wir, indem wir epistemische, materielle und strukturelle Bewertungen von Identitäten unterscheiden. (...) There seems to be a distinctive way in which we can remember events we have experienced ourselves, which differs from the capacity to retain information about events that we can also have when we have not experienced those events ourselves but just learned about them in some other way. Psychologists and increasingly also philosophers have tried to capture this difference in terms of the idea of two different types of memory: episodic memory and semantic memory. Yet, the demarcation between episodic (...) memory and semantic memory remains a contested topic in both disciplines, to the point of there being researchers in each of them who question the usefulness of the distinction between the two concepts. In this paper, I outline a new characterization of the difference between episodic memory and semantic memory, which connects that difference to what is sometimes called the ‘epistemic asymmetry’ between the past and the future, or the ‘epistemic arrow’ of time. My proposal will be that episodic memory and semantic memory exemplify the epistemic asymmetry in two different ways, and for somewhat different reasons, and that the way in which episodic memory exemplifies the epistemic asymmetry is manifest to the remembering subject in a way in which this is not the case for semantic memory. Es werden die ungewollten Wirkungen der Industrialisierung und Modernisierung untersucht. Dazu gehören der Klimawandel, die Zerstörung der Biodiversität, die gestörten biogeochemischen Kreisläufe, die Versauerung der Ozeane und die Verschmutzung des Planeten mit der Gefahr der Zerstörung der Lebensgrundlagen der Menschen, Tiere und Pflanzen. Welche Rolle spielen in diesem Prozess die Maschinen? Ohne ihre Erfindung wäre es nicht zu diesem Prozess mit (...) seinen zahlreichen Nebenwirkungen gekommen. Ihre Entwicklung reicht von der Dampfmaschine über die Prothetik bis zur Robotik. Ein wichtiger Motor der Entwicklung sind heute die digitale Kultur und die Künstlichen Intelligenz. Lassen sich diese auch für die nachhaltige Entwicklung nutzen? Ohne die Digitalisierung wäre es nicht zu den Entwicklungen der Gentechnologie gekommen. Mit der Erfindung und Nutzung der CRISPR-Technologie werden Eingriffe in die Evolution möglich, die sich als eine Zuspitzung der Dynamik des Anthropozäns begreifen lassen. Gibt es Möglichkeiten, die Gefährdungen und die negativen Auswirkungen dieser Entwicklungen zu vermeiden oder sie sogar zu kompensieren? Hier entstehen viele nicht einfach beantwortbare anthropologische Fragen, die für ein historisch und kulturell reflexives (Selbst-)Verständnis des Menschen von zentraler Bedeutung sind. (shrink)

This paper aims to develop a novel account of the normativity of assertion. Its core thesis is that assertion has an etiological epistemic function, viz. to generate knowledge in hearers. In conjunction with a general account of etiological functions and their normative import, it is argued that an assertion is epistemically good if and only if it has the disposition to generate knowledge in hearers. In addition, reason is provided to believe that it makes sense to regulate the practice of (...) assertion by a speaker rule—and, more specifically, by a knowledge rule—as so regulating assertion contributes to ensuring that assertion fulfils its etiological function reliably. Starting with the three major accepted propositions of Blondel’s project , the author proposes a way of reinterpretation in a new cultural perspective of these propositions, notably because of a pluralism that seems at first to be opposed to the fundamentally Christian structure of Blondel’s discourse, which forces one to bend Blondel’s definition of the supernatural. Finally, the outline of an apologetical argument valorises the whole of the circular method of the apologetical argument in so far as this whole is constituted by truth, soundness, and authenticity. In Plato's Republic, the Analogy of the Sun famously points out that as the Idea of the Good relates to the knowable Forms so does the Sun to the visible things. Yet, no one has ever questioned whether the consequences claimed to be caused by the sun – among them especially the vital genesis of all physical things – can, based on Plato's philosophy, actually be caused by the material body of the sun. Taking this as a point of departure, (...) the present article looks into whether one can reveal more of the Analogy, just as Socrates himself frequently emphasises the incompleteness of his presentation. The article thus develops a series of detailed arguments to propose a differentiation of each analogical relation into two subrelations, which imply a transcendent principle and an immanent representation of this principle on both sides of the Analogy. Implementing this differentiation bears the potential to solve existing tensions within the interpretation of Republic VI and VII, it allows for further systematic considerations about, among others, the Good and the Beautiful and it may help to contextualise Plato's Analogy historically.
